MADISON – Boone County Circuit Court officials announced this week that the January term of the Boone County Grand Jury met and returned 28 indictments, including charges of attempted murder, soliciting a minor via computer, operating a meth lab, illegal drugs, and larceny.


Among those included in this round of grand jury indictments include:


* Case No. 14-F-24; Dale Edward Lowther Jr.; One count attempted murder in the first degree, intentionally, feloniously, maliciously, willfully, deliberately, premeditatedly and unlawfully attempting to kill, slay and murder Gary Hubbard; one count malicious assault, unlawfully, feloniously and maliciously shooting, wounding and causing bodily injury to Gary Hubbard, with intent then and there to maim, disfigure, disable or kill the said Gary Hubbard; ten counts wanton endangerment involving a firearm, discharging a .22 caliber rifle, which created a substantial risk of death or serious bodily injury to another.


* Case No. 14-F-17; Charles Aaron Bias; One count soliciting a minor via computer, any person over the age of eighteen, who knowingly uses a computer to solicit, entice, seduce, or lure or attempt to solicit, entice, seduce, or lure, a minor known or believed to be at least four years younger than the person using the computer or a person he or she believes to be such a minor to commit an illegal act, to wit: Charles Aaron Bias being thirty years old, used a computer to ask a minor, E.P.S., who is at least four years younger than him, being fifteen years old, to have sexual intercourse with him against the peace and dignity of the State; one count distribution and display to minor of obscene matter, unlawfully, feloniously, knowingly and intentionally displaying to a minor obscene matter, to wit: by displaying a photograph depicting a hand holding a penis to the minor, E.P.S.


* Case No. 14-F-22; Stanley Lovejoy; One count unlawful assault, unlawfully and feloniously, but not maliciously, wounding and causing bodily injury to Jason Setser with intent then and there to maim, disfigure, disable and kill, the said Jason Setser, to wit: by hitting Jason Setser in the face with a flashlight and causing him injury.


* Case No. 14-M-2, Debbie R. Burgess, Charged with one count simple possession of a controlled substance, Hydrocodone.


* Case No. 14-F-2, 14-F-3; Shelly Elaine Ball & Jerry Lee Ball; Charged with one count operating or attempting to operate a clandestine drug laboratory, manufacturing methamphetamine, methylenedioxymethamohetamine or lysergic acid diethylamide; one count purchase, receipt, acquisition and possession of substances to be used as precursor to manufacture of methamphetamine or another controlled substance; one count conspiracy to operate a clandestine drug laboratory.


* Case No. 14-F-4, 14-F-5; Perry Changes & Steven Brown; One count burgulary, unlawfully, feloniously, and burglariously breaking and entering in the daytime, a dwelling house, to-wit: the residence of Larry and Diana McNeely, Peytona, West Virginia, with intent to commit a larceny therein, against the peace and dignity of the State; one count grand larceny, unlawfully and feloniously stealing, taking, and carryong away, with intent permanently to deprive the owner thereof, one or more of the following items: Savage 12 Guage, Single Shot, serial number P039347, valued at $200.00, Remington .243 caliber, model 788, serial number A6028127, valued at $500.00, and various jewelry, valued at $1,200.00, of the total value of $1,900.00, which is $1,000.00 or more of the valuable money, goods, and chattels of another; one count breaking and entering, unlawfully and feloniously breaking and entering an outbuilding used and occupied by Larry and Diana McNeely, located in Peytona, West Virginia, the said outbuilding, not then and there being a dwelling house or outhouse adjoining thereto or occupied therewith, with intent to commit a larceny therein; one count conspiracy (felony).


* Case No. 14-F-6, 14-F-7; Carmella L. Jarrell & Frank D. Toath; One count manufacturing controlled substance, marijuana; one count conspiracy.


* Case No. 14-F-8, 14-F-9; Rondal Allen Petry & Wayne Richard Boulet; One count grand larceny, unlawfully and feloniously stealing, taking, and carrying away, with intent permanently to deprive the owner thereof, one or more of the following items: a 2004 Honda Foreman 450 S, yellow in color, with VIN#478TE220144520353 of the total value of $3,500.00 which is $1,000.00 or more of the valuable money, goods, and chattels of another to wit: belonging to James Tuener; one count conspiracy.


* Case No. 14-F-10, 14-F-11, 14-F-12; Jeffrey Scott Sharp, Keith Allen Blevins & Tonya Blevins; One count transportations of a controlled substance into state, having a shipment of a quantity of Alprazolam, a Schedule IV controlled substance, mailed from a location out of this State to the post office box belonging to Keith Allen Blevins located in Wharton, West Virginia; one count conspiracy to transport controlled substance into state; one count possession with intent to deliver a controlled substance, Alprazolam.


* Case No. 14-F-13, 14-F-14, 14-F-15, 14-F-16; Danny Ray Griffy, Brandon Shawn Mollett, Terry Lee Davis & Cecil Ray Davis; One count operating or attempting to operate clandestine drug laboratory, methamphetamine, methylenedioxymethamohetamine or lysergic acid diethylamide; one count conspiracy to operate or attempting to operate a clandestine drug laboratory.


* Case No. 14-F-18; Jonathan Hunter Cooper; One count burglary, the residence of Patricia Adkins, Cooperstown, West Virginia, with intent to commit larceny therein; one count grand larceny, unlawfully and feloniously stealing, taking, and carrying away, with intent permanently to deprive the owner thereof, one or more of the following items: Dell laptop computer with charger, valued at $2,000.00, RCA TV with remote, valued at $200.00, Purse, wine in color, valued at $50.00, US Currency, valued at $48.00, coin purse, red in color, valued at $12.00, and Nintendo Gameboy DS, valued at $200.00 of the total value of $2,510.00 which is $1,000.00 or more of the valuable money, goods, and chattels of another to wit: Patricia Adkins; one count fleeing from officer on foot, Deputy Jarrell who is a member of the Boone County Sheriff’s Department, who was attempting to make a lawful arrest while working in his official capacity of the said Jonathan Hunter Cooper and he, the said Jonathan Hunter Cooper, knowing or reasonably believing that said law enforcement officer was attempting to arrest him.


* Case No. 14-F-19; Raven Dotson; Four counts possession of a controlled substance with intent to deliver, Alprazolam, Oxymorphone, Hydrocodone, Clonazepam.


* Case No. 14-F-20; Melanie Duncan; Fifteen counts fraud and related activity in connection with access device, feloniously, knowingly, willfully and with the intent to defraud used an unauthorized access device to access said account for the purpose of obtaining money, which the said account was unauthorized for use to-wit: used the bank account number to access Pam Chafin’s account at BB&T, without Pam Chafin’s authorization, and obtained $193.49, $193.49, $149.94, $158.40, $183.82, $172.49, $172.78, $346.71, $255.04, $508.28, $249.14, $263.84, $283.84, $253.84, and $253.84.


* Case No. 14-F-21; Bradley Ellis; One count fleeing from an officer in vehicle, Deputy Cook, of the Boone County Sheriff’s Department, who was attempting to make a lawful arrest of the said Bradley Ellis and had activated emergency lights and sirens directing the said Bradley Ellis to stop, and he, the said Bradley Ellis, operated the said vehicle in manner showing reckless indifference to the safety of others; one count reckless driving; one count speeding, driving 80 miles per hour in a 65 mile per hour zone; one count improper use of evidences of registration, a license plate registered to a Mitsubishi Eclipse on the said Bradley Ellis’ vehicle which is a Chevrolet full size pick-up truck; one count driving while licenses suspended or revoked.


* Case No. 14-F-23; John Mayhorn; One count obtaining goods and services by false pretenses, four Mud Hog tires with part number 285-70-17, valued at $980.00, a 2 inch leveling kit, valued at $150.00, and labor charges valued at $242.00 form Mikes Tire Shop in Madison, West Virginia, the total of which is $1000.00 or more by making false statements.


* Case No. 14-F-25; Thomas Mullins; Three counts delivery of a controlled substance, Oxycodone.

Taylor; One count grand larceny, by unlawfully and feloniously stealing, taking, and carrying away with intent permanently to deprive the owner thereof, one or more of the following items: DeWalt
