A Loyall man has been arrested on multiple charges related to a burglary that occurred in the early morning hours at Holly Point Apartments in Sunshine on Monday.
James C. Lewis, 23, was placed under arrest by Harlan City Police Officer Mike Ashurst and charged with second-degree burglary, third-degree criminal mischief, tampering with physical evidence, possession of marijuana and public intoxication by a controlled substance (excludes alcohol).
According to the citation, Ashurst said he was on patrol when he responded to a report of a burglary at Holly Point.
“While on patrol this officer responded to 54 Holly Point in reference to a burglary that had just occurred at midnight. The victim advised her upstairs window screen had been busted out and her blinds pulled away. She advised several electronic items were taken from the residence,” stated Ashurst.
Several hours later, Ashurst located and arrested Lewis.
“At approximately 4 a.m. this officer came in contact with the subject (Lewis) on the railroad tracks at the floodwall on U.S. 421,” Ashurst wrote in the citation. “Upon contact, the subject had all matching items on his person that were described to be taken. Once placed inside the patrol unit subject attempted to swallow a green leafy substance suspected to be marijuana. This officer observed subject to be under the influence.”
Lewis was transported to and lodged in the Harlan County Detention Center.
In other police activity, Justin Gilbert, 21, of Harlan, was arrested on Monday by the Harlan City Police Department on a charge of second-degree trafficking a controlled substance. Gilbert was lodged in the Harlan County Detention Center.
