Man accused of sodomy appears in court

A Dayhoit man arrested on sodomy charges made an appearance in Harlan Circuit Court Thursday.

Terry Jenkins, 36, faces a two-count indictment following his arrest on Wilkerson Street in Loyall by Loyall Police Chief Mike Lunsford on April 1.

According to the indictment, Jenkins committed two counts of first-degree sodomy sometime between Sept. 1, 2008 and April 1, 2009.

Both counts of the indictment state Jenkins engaged in deviate sexual intercourse with a minor under the age of 12.

Jenkins appeared in front of Judge Marc Rosen without an attorney.

“You’re before the court on an indictment handed down by the Harlan Grand Jury,” Rosen told the defendant.

Rosen then read pertinent sections of the indictment aloud.

“Do you understand what you’re charged with?” asked Rosen, who then pointed out the charges carried a possible sentence of 20 years to life.

Jenkins verified that he understood the charges.

When asked by the court if he was represented by attorney, Jenkins advised he had not yet hired an attorney, but said he plans to retain Johnnie Turner.

Jenkins, representing himself, requested a copy of the evidence the state has on the case. According to Jenkins, he made the request in order to forward the evidence to Turner.

Commonwealth’s Attorney Parker Boggs handed over the discovery, which consisted of 34 separate pages and 4 CDs. The evidence was then given to Jenkins’ girlfriend to transport to Turner.

Rosen told the court he would not do a formal arraignment on Jenkins at this time in order to allow time for an attorney to be retained.

In other court activity:

* Paul Buell, 30, of Wallins, was sentenced to seven years in prison on an amended charge of second-degree robbery. Buell was also ordered to pay restitution in the amount of $105;

* Daniel Bustle, 33, of Harlan, was sentenced to a total of six years in prison on five counts of second-degree trafficking a controlled substance and fourth-degree controlled substance endangerment of a child. Bustle was ordered to pay restitution totaling $930.
