A Harlan woman found herself placed on diversion probation Thursday in Harlan Circuit Court. Brittany Jones, 25, received her sentence about five months after the incident that led to her arrest.
According to previous Enterprise reports, Jones was arrested by Harlan City Police Officer John D. Noe following an incident in which Jones was arrested along with James Raymond Ball, 21, of Harlan.
“We received a complaint about a domestic at Holly Point Apartments…through the investigation, I figured out prior to going over there Mr. Ball had assaulted her (Jones) and had abused a 3-year-old,” said Noe in the Enterprise report.
Noe pointed out at the time that Jones had not reported the alleged abuse of a child and had hindered the investigation.
“Even after the abuse was reported she continued to hinder our efforts to investigate…She refused to take the child to the emergency room. Mike Boggs had to basically tell her that if she didn’t take (the child) out there that he would place (the child) in protective custody,” said Noe after Jones’ arrest.
Noe stated the abuse was not sexual in nature.
Jones stood in front of Judge James Bowling and entered a guilty plea to the the amended charge of complicity to criminal abuse. After verifying that Jones understood her rights, Bowling accepted the guilty plea and granted a motion for diversion, telling Jones “it’s a really good deal, but you have to live up to it.”
Jones was granted unsupervised diversion probation for three years, with the state recommending a 3 year prison sentence should she fail to meet the requirements of her probation. Jones must not have any violations of the law while her probation is in effect.
Ball is scheduled to appear in court at a later date to face charges of first-degree abuse of a child under 12 years of age.
In other court activity:
* Joseph Edwards, 27, of Harlan, was arraigned on five counts of attempted murder of a police officer and nine counts of first-degree wanton endangerment of a police officer. Edwards was arrested in connection with a shooting incident that occurred on Ivy Hill about three months ago.
