A Dayhoit man who allegedly ran his truck into his ex-wife's vehicle last year on Sukey Ridge has been indicted for attempted murder.
According to the indictment, Richard Brackett, 46, with the intent to cause the death of Cecelia Brackett, struck her vehicle with his vehicle on Oct. 24, 2005.
Kentucky State Police trooper Marcus Williams investigated the crash and presented the case to a Harlan County Grand Jury.
When the incident occurred, it was reported that a 2004 Chevrolet truck driven by Richard Brackett, was traveling south on U.S. 119 when his vehicle allegedly crossed the highway and struck a northbound 2004 Chevrolet blazer, driven by Cecelia Brackett, of Dayhoit, in the driver's side, knocking the Blazer off of U.S. 119 into a ditch.
The truck came to rest several feet past the point of impact in the northbound lane facing south.
Cecelia Brackett had to be extricated from her vehicle by members of the Harlan City Fire Department and the Harlan County Rescue Squad.
The Bracketts were transported to Harlan ARH Hospital.
The crash occurred at approximately 8:30 a.m. The couple were scheduled to be in Harlan Circuit Court at 9 the same morning in a civil domestic case.
Harlan City Police officers Michael Thomas and Josh Howard assisted Williams at the scene and KSP Det. Michael Cornett assisted Williams with the investigation.
Williams said the investigation has consisted of a lot of details requiring quite a bit of time to look into every aspect of the incident.
“There was a motorcycle helmet discovered inside of Mr. Brackett's vehicle by officer Thomas,” Williams said. “Officer Thomas brought the helmet to my attention while I was taking measurements of the crash scene. It is alleged that Mr. Brackett was possibly wearing the helmet during the crash due to evidence collected from inside the vehicle.”
The charge of attempted murder is a Class B felony. If Richard Brackett is convicted of the alleged crime, he could receive up to 20 years in prison.
Brackett was arrested Tuesday by Harlan County Sheriff's Department Sgt. Mike Lunsford and lodged in the Harlan County Detention Center with bond set at $50,000.
In other police news, Wallace Lee Saylor Jr., 35, of Coldiron, and Kenneth Brandon Phillips, 27, of Wallins, were both arrested on robbery indictment warrants.
The men allegedly stole supplies belonging to A&M Mining Company and threatened harm to the security guard during the process.
