District court cases

The following cases have been heard in Harlan District Court, Judge Jeff Brock presiding.

Derrick S. Gross, 19, first-offense driving under the influence of alcohol/drugs, license to be in possession — first charge, amended to alcohol intoxication (complaining party failed to appear), pleaded guilty, fined $100 (court costs waived); other charge dismissed.

Dustin W. Owens, 34, second-offense driving under the influence of alcohol/ drugs, driving on a DUI-suspended license (first offense) — jury trial set July 29.

Dewayne F. Kelly Jr., 27, speeding (26 or more miles per hour over the limit), second-degree fleeing or evading police (in a motor vehicle), reckless driving, disregarding stop sign, operating all-terrain vehicle on roadway, inadequate silencer (muffler) — first charge, amended to speeding (10 miles per hour over the limit), pleaded guilty, fined $148; other charges dismissed.

Dustin Harris, 19, license plate not illuminated, operating vehicle on suspended/ revoked operator’s license, operating motor vehicle under the influence of alcohol/drugs under the age of 21 — jury trial continues Oct. 28.

Jeremy Powell, 27, leaving the scene of an accident/failure to render aid or assistance — dismissed on agreement.

Teddy Vaughn, 43, third-degree terroristic threatening — dismissed on agreement.

Carter L. Turner, third-degree unlawful transaction with a minor — dismissed on agreement of parties.

Phillip Cox, 41, first-offense driving under the influence of alcohol/drugs, first-degree trafficking a controlled substance (first offense), third-degree trafficking a controlled substance (first offense) — pleaded not guilty, jury trial set Oct. 28.

David Hatfield, 32, third-degree terroristic threatening — pleaded not guilty, jury trial set Sept. 2.

Dustin R. Johnson, 18, speeding (10 miles per hour over the limit), careless driving, two counts of failure to comply (instructional permit), failure of owner to maintain required insurance/security (first offense), failure to produce insurance card, failure to give or improper signal — continued for arraignment July 21.

Gregory S. Shoupe, 34, operating vehicle on suspended/revoked operator’s license — continued for arraignment Sept. 15.

Thomas C. Farrow, 20, operating motor vehicle under the influence of alcohol/drugs under the age of 21 — pleaded guilty, fined $653, operator’s license suspended 30 days and sentenced to driving school.

Mike M. Clay, 55, fugitive from another state — dismissed.

Billy R. Price, 41, third-degree assault, third-degree terroristic threatening, menacing — preliminary hearing scheduled July 21.

Chris McMillian, 18, use or possession of drug paraphernalia (first offense) — pleaded guilty, fined $100 (court costs waived) and sentenced to 90 days in jail (probated for 12 months).

Jorge Nicholas, 22, disorderly conduct — pleaded guilty, fined $50 (court costs waived).

Julio Hernandez, 28, disorderly conduct — pleaded guilty, fined $178.

Pastor Lopez, 23, disorderly conduct — pleaded guilty, fined $50 (court costs waived).

Marcor Sesario, 19, disorderly conduct — continued for arraignment.

Juan Sanchez, 27, disorderly conduct — pleaded guilty, fined $178.

John E. Lee, 51, second-degree possession of a controlled substance (first offense) — pleaded guilty, fined $100 (court costs waived) and sentenced to 90 days in jail (probated for 12 months).

Melinda Watts, 48, disregarding stop sign, resisting arrest, criminal coercion — continued for arraignment.

Amy M. Haynes, 28, public intoxication under a controlled substance (excludes alcohol) — pleaded guilty, fined $25 (court costs waived).

Jody Taylor, 25, third-degree unlawful transaction with a minor — continued for arraignment.

Aaron C. Taylor, 27, first-offense driving under the influence of alcohol/drugs, second-degree fleeing or evading police (in motor vehicle), second-degree disorderly conduct — pleaded not guilty, jury trial set Oct. 7.

Mary Fields, 22, alcohol intoxication in a public place (first offense), second-degree disorderly conduct — pleaded guilty, fined $75 (court costs waived).

April Bennett, 24, alcohol intoxication in a public place (first offense), second-degree disorderly conduct — pleaded guilty, fined $75 (court costs waived).

Billy R. Price, 41, second-offense operating motor vehicle under the influence of alcohol/drugs, leaving the scene of an accident/failure to render aid or assistance, third-degree terroristic threatening, second-degree disorderly conduct — pretrial conference scheduled July 21.

Carson R. Welch, 43, first-offense driving under the influence of alcohol/drugs, expired or no registration plate, two counts of expired or no Kentucky registration receipt, failure to produce insurance card, failure of owner to maintain required insurance/security (first offense), failure to register transfer of a motor vehicle, careless driving, resident registered vehicle in other state — pleaded not guilty, jury trial set Oct. 28.

Jimmy Bright, 36, first-offense driving under the influence of alcohol/drugs, operating all-terrain vehicle on roadway, no operator’s/ moped license, second-degree fleeing or evading police (on foot) — pleaded not guilty, jury trial set Oct. 28.

Billy L. Jones, 26, third-degree unlawful transaction with a minor — pretrial conference scheduled July 21.

Todd Parker, 44, fourth-degree assault (domestic violence with minor injury) — continued for arraignment.

Vernon Ledford, 27, first-offense driving under the influence of alcohol/drugs, use or possession of drug paraphernalia (first offense) — pleaded not guilty, jury trial set Oct. 28.

Diana M. Santi, 40, first-offense driving under the influence of alcohol/drugs, failure to wear seat belt, failure to produce insurance card, failure of owner to maintain required insurance/security (first offense), third-degree possession of a controlled substance (first offense), controlled substance prescription not in original container (first offense), possession of an open alcoholic beverage container in a motor vehicle — pleaded not guilty, jury trial set Oct. 28.

Michael Q. Pace, 43, alcohol intoxication in a public place (third offense or more within 12 months), possession of an open alcoholic beverage container in a motor vehicle — pleaded guilty, fined $50 (court costs waived).

David Jones, 20, possession of marijuana, use or possession of drug paraphernalia (first offense) — pleaded guilty, fined $200 and sentenced to 120 days in jail (probated for 12 months).

Holly Madewell, 18, theft by unlawful taking (shoplifting, under $300) — pleaded guilty, fined $100 (court costs waived), sentenced to 30 days in jail (probated for 12 months) and ordered to stay out of Don’s Super Saver.

Ellis Scott, 69, alcohol intoxication in a public place (first offense), second-degree disorderly conduct — continued for arraignment.

Johnny W. Risner, 36, fourth-degree assault (domestic violence with no visible injury) — pleaded not guilty, jury trial set Oct. 7.

Dan L. Shuler, 36, first-offense driving under the influence of alcohol/drugs, second-degree possession of a controlled substance (first offense), controlled substance prescription not in original container (first offense) — pleaded not guilty, jury trial set Oct. 28.

Harold Wilson, 34, fourth-degree assault (domestic violence with no visible injury) — pleaded not guilty, jury trial set July 8.

Katina D. Bledsoe, 35, possession of marijuana, use or possession of drug paraphernalia (first offense) — pleaded guilty, fined $200 (court costs waived) and sentenced to 120 days in jail (probated for 12 months).

Bill Burger, 64, violation of solid waste ordinance — continued for arraignment.

Rayborn Dye, 62, menacing — jury trial set Aug. 26.

Joseph D. Doan, 33, fourth-degree assault (domestic violence with no visible injury) — continued for arraignment.

Bobbi L. Foley, 29, speeding in a restricted zone, failure to wear seat belts, failure to produce insurance card, second-offense driving under the influence of alcohol/drugs, second-degree disorderly conduct, resisting arrest, carrying a concealed deadly weapon, possession of an open alcoholic beverage container in a motor vehicle — pleaded not guilty, jury trial set Oct. 7.

Tammy H. Hicks, 40, expired or no registration plate, expired or no Kentucky registration receipt, operating vehicle on suspended/revoked operator’s license — continued for arraignment July 7.
