Police arrest two in pawn shop burglary

The Harlan City Police Department has made two arrests in the burglary that occurred at Cumberland Jewelry and Pawn Shop on Sept. 16 where seven guns were stolen.

On Monday, officer Erik Saylor arrested Dewayne Edward Harris, 23, of Harlan, on a warrant and charged him with theft by unlawful taking of property valued at over $300 (firearm) and theft by deception under $300.

According to the warrant, it is alleged that Harris sold a stolen handgun to Kate Couch, of Evarts, for $200 on Sept. 20. The handgun was confirmed stolen through NCIC. The gun was reported stolen from Cumberland Jewelry and Pawn Shop.

On Tuesday, Saylor arrested Michael Shane Cloud, 21, of Loyall, on a warrant and charged him with first-degree burglary, first-degree criminal trespassing, first-degree criminal mischief, theft by unlawful taking of property valued at over $300 (firearm) and being a persistent felony offender.

According to the warrant, it is alleged that Cloud entered the Cumberland Jewelry and Pawn Shop, located at 110 Central Street, by throwing a brick through a glass door to gain entry and took seven firearms from a gun case, which he also broke to gain access.

Harlan Police Chief Mike Thomas said Couch came forward with one of the seven stolen guns. Thomas said Couch brought a 9mm Glock to the Cumberland Jewelry and Pawn Shop to see if it was one of the guns that had been stolen. Thomas said Couch stated that she had bought the gun from Harris.

Thomas said Harris gave statements that he did have the gun in question and that he was given the gun by Cloud.

“Mr. Harris stated that Mr. Cloud had broken into the pawn shop and gave him the gun to get rid of,” Thomas said. “Mr. Cloud had also been identified by witnesses who placed him in the area at the time of the burglary.”

Thomas said Cloud was recently questioned and considered a suspect by the Harlan Police Department.

“There has been a lot of effort put into this case and has been a priority with the department,” Thomas said. “This has been a team effort with several officers working together to make an arrest and recover these guns.”

The owner of the pawn shop, Lanola Parsons, said she “highly commend(s) the Harlan Police Department for their quick response to the scene and their diligent work in the case.”

Cloud was lodged in the Harlan County Detention Center with bond set at $50,000. Harris’ bond has been set at $10,000.

Thomas said the investigation is ongoing and more arrests are pending. Six guns remain missing but are entered into NCIC. Anyone with any knowledge in regard to the burglary and missing guns are still encouraged to call the Harlan Police Department at 573-1121.

In other police news:

-- Joseph Dean Napier, 48, of Evarts, was arrested Monday at a fire scene by Harlan County sheriff’s Det. Silas Whitehead. Napier was charged with third-degree arson, third-degree assault, disorderly conduct and alcohol intoxication.

According to the police citation, Napier came onto a fire scene where members of the Lower Clover Fork Fire Department were attempting to extinguish a fire of a trailer near the saw mill in Evarts. It is alleged that Napier pulled a vehicle between the fire and a fire truck, got out and tried to stop the fire department from putting the fire out. Napier was allegedly under the influence of alcohol and assaulted the fire chief while the fire department was fighting the fire that Napier allegedly started. The trailer and several tires were destroyed in the blaze.

Joseph Napier was lodged in the Harlan County Detention Center with bond set at $25,000.

Sheriff Marvin Lipfird said his department is also investigating a double fire that occurred Saturday at Rio Vista. Arrests are pending as the investigation continues.

-- Shane M. Lunsford, 27, of Dayhoit, was arrested by KSP trooper Bryan Johnson on charges of receiving stolen property, reckless driving, operating an ATV on the roadway, two counts of failure to comply with helmet law and one count of operating a motor vehicle on a suspended license.

-- Odiss Olin Cothern, 39, of Cumberland, was arrested by deputy Danny Lewis on a fugitive from another state warrant.

-- Danny Reed Ward Jr., 26, of Evarts, was arrested by deputy Eddie Jones on a fugitive from another state warrant.
