Man sentenced, ordered to leave state

A Michigan man was sentenced in Harlan Circuit Court on Thursday on charges including trafficking a controlled substance.

On Dec. 1, 2008, a four-count indictment was handed down against Mark Clark, 47, of Dearborn.

Clark was indicted on charges of engaging in organized crime, first-degree trafficking in a controlled substance, second-degree trafficking in a controlled substance, and possession of a handgun by a convicted felon.

“The defendant was knowingly and unlawfully trafficking in a controlled substance by being in possession of oxycodone, a schedule two narcotic, with the intent to distribute or sell said narcotic,” reads the indictment.

The indictment shows Clark also possessed and intended to distribute or sell hydrocodone.

According to the indictment, Clark committed the offenses in June 2008.

Special Judge James Bowling sentenced Clark on three of the four counts, with the charge of engaging in organized crime being dismissed.

Clark was sentenced to five years in prison on the count of first-degree trafficking in a controlled substance, three years on the second-degree trafficking charge and 10 years for felon in possession of a firearm. The sentences were ordered to run concurrently for a total of 10 years in prison. The sentence was probated for 10 years.

Bowling advised Clark that he must leave the state in order to comply with his probation.

“You are to remain outside the entire Commonwealth of Kentucky,” stated Bowling.

In other court activity:

* Sabrina Jackson, 39, of Dayhoit, was sentenced at the state’s recommendation on a charge of second-degree trafficking in a controlled substance to five years in prison, probated for five years. Jackson was ordered to serve 90 days in jail as a condition of probation;

* Terry Henry Jr., 37, of Calvin, was sentenced to one year in prison on a charge of complicity to promoting contraband;

* Carla Noe, 47, of Wallins, was sentenced on a charge of third-degree trafficking in a controlled substance. At the Commonwealth’s recommendation, Noe received a five-year prison sentence, probated for five years. The first three years of probation will be supervised.
