Man enters guilty plea on cocaine charge

A Cumberland man was scheduled to stand trial on Wednesday, but instead entered a plea of guilty after accepting a plea bargain from the Commonwealth’s Attorney’s Office.

Frank Everett Lee Jr., 28, entered the guilty plea rather than taking a chance on a jury verdict.

The Harlan County Grand Jury handed down a two-count indictment against Lee on March 19. The indictment charged Lee with one count of first-degree trafficking a controlled substance and with being a persistent felony offender.

According to the indictment, Lee “knowing and unlawfully trafficking in a controlled substance by selling or transferring crack cocaine, a schedule II narcotic.”

The indictment states the offense happened on or about June 9, 2010.

According to the Harlan Circuit Court Clerk’s Office, Lee entered a plea on two separate cases, agreeing to five years on the 2012 indictment and one year on an earlier case.

The commonwealth has recommended a total sentence of six years in prison for the trafficking charge, having dismissed the persistent felony offender charge.

Lee’s sentencing has been set for Jan. 3.
